Terms & Conditions

All bookings are subject to the following Terms and Conditions and the parties agree to be bound thereby:

1. DEFINITIONS

In these Terms and Conditions,

“Client” shall mean the legal person or persons to whom Platinum Pass Pty Ltd ACN 125 428 042 (“Platinum Pass”) is obliged to provide the Event.

“Event” shall mean the provision of booking facilities, passes, corporate hospitality, event information, event execution and any other services.

“Event Provider” shall mean the issuer of the Event package, pass and/or ticket (as applicable).

“Price” shall mean the cost for the Event, exclusive of all (if any) Goods and Services Tax.

2. PAYMENT

  • The Client must pay Platinum Pass in full the amount equal to the Price plus GST and all other amounts payable in respect of the Event in order to secure a booking.
  • Subject to item 5 and item 7 below, if after securing a booking, an Event is not available to the Client then Platinum Pass will provide to the Client a 100% refund.
  • Platinum Pass does not accept any liability for unavailability of Events despite system showing availability. (E.g. this may happen if supplier made error and has inventory available when its actually not available)
  • Platinum Pass may receive payment from an Event Provider for an Event booking.

3. TICKETING

Client hospitality passes and final Event information will be dispatched approximately two (2) weeks prior to the Event.

Platinum Pass merely acts as an agent for the Event Provider. Where arrangements are made to transfer tickets to a Client this will be within the legal ticketing terms and conditions of the Event Provider.

4. CLIENT CANCELLATION

Penalties or fees for cancelling a booking will depend on the policy of the Event Provider.

In addition to any penalties or fees under the cancellation policy of the Event Provider, an administration fee payable to Platinum Pass of 25% of the Price or $250 (whichever is the greater) applies to all cancellations.

5. ALTERATION TO THE ADVERTISED PACKAGE

Every reasonable effort will be made to adhere to the advertised Event package, but any Event package may be altered or part omitted or dates changed for any cause for which Platinum Pass in its absolute discretion shall consider to be appropriate or which is beyond the control of Platinum Pass.

6. LIABILITY

In making arrangements with third parties for carriage by air, hotel accommodation, transportation, restaurants or otherwise, Platinum Pass acts only as the agent of the Event Provider and does so on the express condition that no liability of any kind howsoever caused shall attach to Platinum Pass in connection with or arising out of such arrangements.

Platinum Pass does not accept liability for any errors or omissions on its website, event information or booking forms and reserves the right to change the information published on its website at any time.

Platinum Pass does not accept liability for any indirect or consequential loss arising out of the use or connected with its website or for any packages, products or Events purchased via its website.

Platinum Pass makes no warranty or representation about the fitness or suitability of any packages, products or Events advertised on its website or booked by the client.

7. CANCELLATIONS OF EVENT

Should for any reason an Event be partly or wholly cancelled no refunds can be made unless the Event Provider agrees to partly or wholly refund Platinum Pass. Clients may take out insurance coverage through its own broker.

Should an Event booking, package, pass or ticket for any reason be destroyed or made unusable, no refund shall be made.

8. CLIENT’S DUTIES

The Client must abide by the terms and conditions of the Event Provider in relation to the Event.

The terms and conditions of the Event Provider form part of these Terms and Conditions. The terms and conditions of the Event Provider are either displayed on this website or available from Platinum Pass on request.

Any complaints or claims are the responsibility of the Event Provider and not Platinum Pass as agent for the Event Provider.

Platinum Pass itself and on behalf of the Event Provider reserves the right to refuse entry or to allow participation in the Event to any Client or any Client’s guest on the day of the Event if the Client or guest behaves in any manner which is in the opinion of Platinum Pass likely to cause offence or injury to any other party.

Notwithstanding the foregoing, the Client shall be liable with regard to any loss, damage, cost, expense or injury incurred or suffered by the Platinum Pass which relates to or arises out of the acts or omissions of the Client or the Client’s guests and the Client shall indemnify the Platinum Pass accordingly. This obligation shall be without limit of time.

9. LICENSING

Where necessary Platinum Pass and the Client shall adhere to the local licensing conditions for alcohol and other regulations in relation to an Event.

10. NUMBERS

Should the Client wish to increase the number of persons using the Event it must contact Platinum Pass at least 2 weeks before the Event. Platinum Pass cannot guarantee additional persons will be able to be accommodated.

11. INDEMNITY

Client hereby indemnifies and holds Platinum Pass harmless from and against any and all costs, damages, and expenses, including attorney’s fees, which are incurred by the Client, it’s agents, employees and guests, or for which Platinum Pass becomes liable as a result of the conduct of the Client, its agents, employees and guests.

12. MISCELLANEOUS

These Terms and Conditions and any invoice provided in relation to an Event booking constitute the sole and exclusive agreement between the parties. Client acknowledges that no other warranties, representatives, or acknowledgments, written or verbal, have been made which are not reflected herein.

a. Should a portion of the total charge in relation to the goods or services be subject to any tax regulations including a goods and service tax, this will be added to the final invoice.

b. Both parties submit the sole jurisdiction of the N.S.W Courts in the event that any disagreement should arise out of these Terms and Conditions.

c. These Terms and Conditions shall be binding between Platinum Pass and the Client upon acceptance by the Client to these Terms and Conditions.

d. The person accepting on behalf of the Client warrants that they have full authority to bind the Client.

13. CONDITION OF SALE

It is a condition of sale that an Event booking may not, without the prior written consent of Platinum Pass, be resold at a premium nor used for advertising, promotion or other commercial purposes (including competitions or trade promotions) or to enhance the demand for other goods or services.

14. LAW

These Terms and Conditions shall be governed by and construed in accordance with the law of Australia.
